Looks like there's more trouble brewing for the city officials...

A former spokeswoman for the Jacksonville Fire and Rescue Department has sued the city, citing gender discrimination. Bennie Seth, whose annual salary was $55,000 when she left the department in August 2006, claims that other male public information officers in the city and other fire department division chiefs made more money than she did while at the city, according to a lawsuit filed in federal court Nov. 20.

While Seth was working for the city, “Mayor Peyton stated something to the effect of ‘don’t pay her much, her husband makes a lot of money,’” according to the lawsuit.

Prior to working for the city, Seth was a volunteer on Mayor John Peyton’s campaign. Seth received one raise since she started with the city in July 2003 making $42,000, but other requests were turned down, according to the lawsuit.

The lawsuit alleged that every time then-Fire Chief Rick Barrett requested a raise for Seth, “vicious and unfounded rumors about a relationship” between her and Barrett would circulate and she wouldn’t get her raise.

In August 2006, Seth told the Times-Union that Barrett asked her to resign at the request of Peyton’s office. Barrett told the Times-Union at the time that Seth was asked to leave because the city was reorganizing its public information office. Seth then went to work for Supervisor of Elections Jerry Holland from September through May when he said he cut her position because of budget issues.

Former JFRD Spokeswoman Sues City, Charging Sex Discrimination

JACKSONVILLE, Fla. -- The woman who was once the voice of the Jacksonville Fire Rescue Department has filed a lawsuit against the city, charging that she was the victim of sex discrimination.

Bennie Seth used to be the spokeswoman for JFRD. Now, she's suing the city because of what she called vicious rumors and pay discrimination because of her gender.


In August 2006, Seth resigned her post, telling Channel 4 she was forced by the mayor's office to resign but said she did not know exactly why.
A copy of the lawsuit, obtained by Channel 4 on Monday, revealed what Seth claims happened between her and the department.

The lawsuit states, "During the time Seth was working for the city... Mayor Peyton stated something to the effect of don't pay her much; her husband makes a lot of money."

The suit also states despite receiving stellar performance evaluations, every time Fire Chief Richard Barrett requested a pay raise for Seth, vicious and unfounded rumors about a relationship between Seth and Barrett began to circulate and she would not get the requested raise.

On Monday, Seth told Channel 4 she could not comment about the pending lawsuit, but said she was surprised the news made it out because the suit was recently moved to federal court.

Other allegations in the lawsuit include: that Seth was paid less than male employees who had fewer responsibilities and no supervisory duties over any employees, that the city's failure to pay Seth all wages due was willful and intentional and that the city cannot justify the difference in pay to Seth.

As the spokeswoman for JFRD, Seth was paid $55,000. Her replacement at the time was being paid about $49,000 and is currently making $51,000.

Am curious to see how this all pans out....what comes to mind is the fairly recently settled case against the promotions of several firefighters that were held back....and they won.

Just a reminder of the Mayoral mouthpiece's statement when Seth first resigned last year about the same time as Chip Patterson left the Emergency Operations program:

Seth is the sixth highly visible city employee to go in recent weeks. The mayor office said there's a reason why it's all happening now.


"They are being sought after by private sector industry and we wish them well in those adventures," Skipper said.


Seth is expected to leave Sept. 1.

Funny, I wasn't aware that the Tax Collector's office, which is where Seth landed, was considered the private sector industry.
